SAFER SCHOOLS FOUNDATION, P2P FIT AND SAFE, & JROTC
READINESS: COMPREHENSIVE LEGAL ACKNOWLEDGMENT,
RELEASE OF LIABILITY, AND ASSUMPTION OF RISK AGREEMENT

EFFECTIVE DATE: JUNE 1, 2026, AND CONTINUING IN PERPETUITY WITHOUT END

BY PROCEEDING WITH PARTICIPATION IN ANY SAFER SCHOOLS FOUNDATION (SSF)
PROGRAM, INCLUDING THE 7-TIER YOUTH TRAINING PROGRAM, THE JROTC
READINESS CURRICULUM, THE "STARTING EARLY" AT-HOME CURRICULUM, AND ANY
FUTURE EDUCATIONAL, TRAINING, OR TEACHING PROGRAMS DEVELOPED,
RELEASED, OR ENDORSED BY THE SAFER SCHOOLS FOUNDATION OR P2P FIT AND
SAFE, YOU (THE "PARTICIPANT" OR "LEGAL GUARDIAN") HEREBY EXPRESSLY
ACKNOWLEDGE, AGREE, AND AFFIRM THE FOLLOWING TERMS. YOUR
PARTICIPATION CONSTITUTES A BINDING LEGAL AGREEMENT.

I. ACKNOWLEDGMENT OF INHERENT RISKS

You acknowledge that participation in physical training, safety instruction, and de-escalation
techniques involves strenuous exertion and inherent risks, including but not limited to: serious
physical injury, permanent disability, property damage, psychological trauma, and death. You
voluntarily assume all such risks, known and unknown, even if arising from the negligence of the
Releasees.

II. EQUIPMENT OWNERSHIP, CUSTODY, AND LIABILITY

Upon the delivery of any training equipment, accessories, or materials to your site (school,
home, or facility), the following terms apply:

• Transfer of Responsibility: Effective the moment equipment and all associated

      accessories arrive on site, all liability, risk of loss, and duty of care regarding said
      equipment and accessories transfers entirely to the recipient or facility.

​

• Release from Equipment Claims: Neither the Safer Schools Foundation (SSF), P2P Fit

      and Safe LLC, nor any associated instructors, affiliates, or partners are responsible for
      equipment or accessory failure, misuse, improper installation, or any injury resulting from
      the use or presence of said equipment and accessories.

​

• Inspection Duty: It is the sole responsibility of the Participant or Facility Manager to

      perform a thorough safety inspection of all equipment and accessories prior to every use.
      If equipment or accessories appear damaged, worn, bent, or frayed, they must not be
      used under any circumstances.

III. FACILITY RESPONSIBILITY AND AGREEMENT

Any facility hosting SSF, P2P Fit and Safe, or JROTC programming accepts full and sole
responsibility for maintaining a safe environment. This includes, but is not limited to:

• Ensuring the training area is free of debris, hazards, moisture, or environmental dangers.

• Ensuring all equipment and accessories are utilized in accordance with safety standards and provided guidelines.

• Providing adequate supervision for all sessions.

• The Facility agrees to indemnify and hold harmless the Safer Schools Foundation (SSF)

      and P2P Fit and Safe LLC from any claims arising from accidents or incidents occurring
      on the premises.

IV. PARTICIPANT RESPONSIBILITY AND AGREEMENT

The Participant agrees to:

​

• Seek a full medical examination from a licensed physician before commencing any program.

• Assume absolute responsibility for their personal health, limitations, and medical needs.

• Refrain from attempting any exercises or techniques if they have pre-existing conditions or injuries.

• Follow all provided safety protocols strictly.

V. RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND FUTURE-PROOFING

IN CONSIDERATION OF BEING PERMITTED TO PARTICIPATE, YOU HEREBY RELEASE,
WAIVE, DISCHARGE, AND COVENANT NOT TO SUE SAFER SCHOOLS FOUNDATION
(SSF), P2P FIT AND SAFE LLC, THEIR OFFICERS, DIRECTORS, EMPLOYEES,
VOLUNTEERS, CONTRACTORS, TRAINERS, AND AFFILIATES (COLLECTIVELY "THE
RELEASEES") FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, CAUSES OF ACTION,
OR EXPENSES WHATSOEVER, REGARDLESS OF WHETHER SUCH CLAIMS ARE BASED
ON NEGLIGENCE, STRICT LIABILITY, BREACH OF CONTRACT, OR ANY OTHER THEORY
OF LAW. THIS RELEASE IS ABSOLUTE, COMPREHENSIVE, AND BINDING IN
PERPETUITY—NOW, ONGOING INDEFINITELY, AND INTO THE FUTURE. UNDER NO
CIRCUMSTANCES SHALL THE RELEASEES BE HELD RESPONSIBLE OR LIABLE FOR
ANY ACTIONS, INTERPRETATIONS, OR MISINTERPRETATIONS OF THIS TRAINING OR
ANY FUTURE PROGRAMS BY ANY PERSON, AT ANY TIME, REGARDLESS OF THE
NATURE OF THE GRIEVANCE. YOU WAIVE THE RIGHT TO HOLD THE RELEASEES
ACCOUNTABLE FOR ANY CLAIMS ARISING FROM THE APPLICATION, MISAPPLICATION,
OR PERCEIVED CONSEQUENCES OF THIS CURRICULUM, NOW OR AT ANY POINT IN
YOUR FUTURE DAYS.

VI. INDEMNIFICATION AND GOVERNING LAW

You agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or
costs, including reasonable attorney fees and court costs, that they may incur as a result of your
participation or your breach of this agreement. This agreement is governed by the laws of the
State of Oregon, and any legal action shall be brought exclusively in a court of competent
jurisdiction located in Oregon.

VII. NO GUARANTEES

The Safer Schools Foundation and P2P Fit and Safe make no representations or warranties,
express or implied, regarding the outcome of these programs. Participation does not guarantee
safety, the prevention of trauma, or the successful acquisition of specific skills. All programs are
provided for educational and informational purposes only.

BY ENGAGING WITH ANY MATERIALS, CURRICULUM, OR EQUIPMENT PROVIDED BY
THE SAFER SCHOOLS FOUNDATION OR P2P FIT AND SAFE, YOU CONFIRM THAT YOU
HAVE READ, UNDERSTOOD, AND VOLUNTARILY ACCEPT THIS AGREEMENT IN ITS
ENTIRETY. THIS AGREEMENT IS BINDING UPON YOU, YOUR HEIRS, NEXT OF KIN,
EXECUTORS, AND ADMINISTRATORS.
